Key groups reach immigration deal as overhaul advances

WASHINGTON (Reuters) - Prospects for a broad U.S. immigration overhaul brightened on Saturday after major U.S. business and labor groups reached an agreement on a guest-worker program, a source familiar with the deal said.

The agreement was reached on Friday night in a conference call between the head of the U.S. Chamber of Commerce, Tom Donohue, and the president of the AFL-CIO labor organization, Richard Trumka, with New York Democratic Senator Chuck Schumer acting as the mediator, according to the source, who spoke on condition of anonymity.

A guest-worker program has been a major stumbling block to efforts by a bipartisan group of senators known as the Gang of Eight to reach a compromise on a way to create a pathway to citizenship for the 11 million illegal immigrants in the United States, most of whom are Hispanics.

Labor unions have argued against a guest-worker program, worrying that a flood of low-wage immigrant laborers would take away jobs from Americans. The agreement covers the pay levels for low-skilled temporary workers and the types of jobs that would be included.

Schumer briefed White House Chief of Staff Denis McDonough on Saturday on the breakthrough, the source said.

The agreement still must be approved by the Gang of Eight senators, four Democrats and four Republicans. If they do so as expected, Senate legislation on a broad new immigration law would be advanced in the Senate in the coming weeks.

In recent days, the immigration effort had been stalled by failure to forge an agreement on the guest-worker program, although the White House insisted that progress was being made.

President Barack Obama wants to fulfill a campaign pledge by gaining passage of a law that would create a pathway to citizenship for illegal immigrants currently in the country. He has vowed to do what he can on immigration through executive actions in the absence of legislation.

Immigration long has been a controversial issue in the United States and previous efforts to craft a comprehensive overhaul of American immigration laws have failed, with Democrats and Republicans remaining far apart.

Many Republicans previously had taken a hard position against illegal immigrants. Obama's unsuccessful Republican challenger last year, Mitt Romney, had advocated "self-deportation" of illegal immigrants. Republicans in Arizona and other states passed tough laws cracking down on illegal immigrants.

But the mood for a deal is ripe because Republicans saw Hispanic Americans vote overwhelmingly for Obama and other Democratic candidates in last November's elections and they need to woo this increasingly important voting bloc.

Many Republicans see gaining favor with the Hispanic voting bloc, which accounts for 10 percent of the U.S. electorate and is growing, as a matter of political survival.

Republicans want to ensure that security along the U.S.-Mexican border is improved before immigrants can get on a path to citizenship. Obama feels security is sufficient but this disagreement is not seen as a deal-breaker.

"We're seeing right now a good bipartisan spirit," Obama told Spanish-language network Univision on Wednesday. "I want to encourage that and hopefully we'll be able to get it done."

Egypt's state prosecutors ordered the arrest Saturday of a popular television satirist for allegedly insulting Islam and the country's leader, in a move that government opponents say is aimed at silencing critics of Islamist President Mohammed Morsi.

The arrest warrant for against Bassem Youssef, who has come to be known as Egypt's Jon Stewart, followed an order earlier this week by the country's top prosecutor to arrest five prominent pro-democracy activists in what the opposition has characterized as a widening campaign against dissent.

The acceleration in legal action targeting protesters, activists and critics comes against a backdrop of continued unrest in the country. Political compromise between the well-organized Islamists in power and their vocal liberal and largely secular critics remains elusive, while the country's economy is in near free fall, which has increasingly fueled popular frustration.

The opposition charges that Morsi, in office for nine months, and the Brotherhood have failed to tackle any of the nation's most pressing problems and are trying to monopolize power, breaking their promises of inclusiveness. Morsi blames the country's woes on nearly three decades of corruption under his predecessor, Hosni Mubarak, and accuses the opposition of stoking unrest for political gain.

The warrant against Youssef is the latest in a series of legal actions against the comedian, whose widely-watched weekly show, "ElBernameg" or "The Program," has become a platform for lampooning the government, opposition, media and clerics. He has also used his program to fact-check politicians.

The fast-paced show has attracted a wide viewership, while at the same time earning itself its fair share of detractors. Youssef has been a frequent target of lawsuits, most of them brought by Islamist lawyers who have accused him of "corrupting morals" or violating "religious principles."

Prosecutor Mohammed el-Sayed Khalifa told Al-Ahram online that he has heard 28 plaintiffs accusing Youssef of insulting Islam, mocking prayers, and "belittling" Morsi in the eyes of the world and his own people.

In one episode of the show, Youssef mocks former militants who are now part of the mainstream political scene in Egypt. At a recent rally, some former radicals who were imprisoned for taking part in the assassination of late President Anwar Sadat in 1981, accused the opposition of using violence at anti-Morsi protests.

In the program, Youssef ridicules an Islamist who said the militants had repented by fasting for three months for mistakenly killing others with Sadat.

"What a message," Youssef says. "Anyone can form a group in the name of religion, assassinate in the name of religion, and then oops! Repent and fast for three months, and it will too pass in the name of religion."

The comedian has faced several court cases in the past accusing him of insulting Morsi. One of Youssef's attorneys, Gamal Eid, said however that this is the first time an arrest warrant has been issued for the comedian.

In a post on his official Twitter account, Youssef said he will hand himself in to the prosecutor's office Sunday. He then added, with his typical sarcasm: "Unless they kindly send a police van today and save me the transportation hassle."

Eid said the warrant fits into a widening campaign against government critics, media personalities, and activists, saying "the prosecution has become a tool to go after the regime's opposition and intimidate it."

A call to a top aide to the country's chief prosecutor, Hassan Yassin, for comment went unanswered.

The other recent arrest warrants for five high-profile activists were issued over allegations that they instigated violence last week near the Brotherhood's headquarters in Cairo, where nearly 200 people were injured in clashes between anti-government protesters and supporters of the Brotherhood, from which Morsi hails.

Morsi responded by harshly criticizing his opponents, calling them hired thugs out to derail Egypt's democracy. The Brotherhood also blamed privately-owned media for fanning the violence.

The criticism was followed by a two-day protest by dozens of Islamists outside the studios of TV networks critical of Morsi. The protesters pelted police and prevented some talk show hosts and guests from entering or leaving the complex.

The New York-based Committee to Protect Journalists called the escalation of anti-press "rhetoric" by Morsi and his supporters and the sit-in outside the media city were "deeply troubling."

The series of prosecutions and arrest warrants come amid a legal challenge to the chief prosecutor, Talaat Abdullah, whose appointment by Morsi last year was declared void by a court ruling earlier this week.

On Saturday, Abdullah said he will appeal the court ruling, saying it is "in violation of the constitution and the law," Egypt's state news agency reported. The decision signals a protracted legal battle is likely to ensue, further confusing the legal scene in Egypt.

In the Mediterranean port city of Alexandria, an Egyptian rights group said Saturday that police detained 13 people, including five lawyers, and accused them of assaulting police. The arrests inside the police station mark a rare instance in which lawyers face potential criminal charges.

The Haqanya Center for Rights said the 13 are accused of insulting security officials, attempting to free other detainees at the police station and illegal assembly.

The arrests prompted an angry response from lawyers at Cairo's Bar Association, who demanded an apology from the police.

Those detained include prominent lawyer and pro-democracy activist Mahienour el-Masry. Several dozen Cairo protesters held a rally outside the chief prosecutor's office, dismissing his orders as void, locking up the gates to his office with chains and demanding the release of the lawyers and activists.

Mohammed Abdel-Aziz, an attorney, said the lawyers and activists were beaten and assaulted at the station, where they had been since Friday to represent three opposition members reportedly detained and taken to the police by members of a political party affiliated with the Brotherhood.

ATLANTA (AP) ? As more Republicans give in to President Barack Obama's health-care overhaul, an opposition bloc remains across the South, including from governors who lead some of the nation's poorest and unhealthiest states.

"Not in South Carolina," Gov. Nikki Haley declared at the recent Conservative Political Action Conference. "We will not expand Medicaid on President Obama's watch. We will not expand Medicaid ever."

Widening Medicaid insurance rolls, a joint federal-state program for low-income Americans, is an anchor of the law Obama signed in 2010. But states get to decide whether to take the deal, and from Virginia to Texas ? a region encompassing the old Confederacy and Civil War border states ? Florida's Rick Scott is the only Republican governor to endorse expansion, and he faces opposition from his GOP colleagues in the legislature. Tennessee's Bill Haslam, the Deep South's last governor to take a side, added his name to the opposition on Wednesday.

Haley offers the common explanation, saying expansion will "bust our budgets." But the policy reality is more complicated. The hospital industry and other advocacy groups continue to tell GOP governors that expansion would be a good arrangement, and there are signs that some Republicans are trying to find ways to expand insurance coverage under the law.

Haslam told Tennessee lawmakers that he'd rather use any new money to subsidize private insurance. That's actually the approach of another anchor of Obama's law: insurance exchanges where Americans can buy private policies with premium subsidies from taxpayers.

Yet for now, governors' rejection of Medicaid expansion will leave large swaths of Americans without coverage because they make too much money to qualify for Medicaid as it exists but not enough to get the subsidies to buy insurance in the exchanges. Many public health studies show that the same population suffers from higher-than-average rates of obesity, smoking and diabetes ? variables that yield bad health outcomes and expensive hospital care.

"Many of the citizens who would benefit the most from this live in the reddest of states with the most intense opposition," said Drew Altman, president of the non-partisan Kaiser Family Foundation.

So why are these states holding out? The short-term calculus seems heavily influenced by politics.

Haley, Haslam, Nathan Deal of Georgia and Robert Bentley of Alabama face re-election next year. Mississippi Gov. Phil Bryant is up for re-election in 2015. Louisiana Gov. Bobby Jindal is term-limited at home but may seek the presidency in 2016. While they all govern GOP-leaning states, they still must safeguard their support among Republican voters who dislike large-scale federal initiatives in general and distrust Obama in particular. Florida's Scott, the South's GOP exception on expansion, faces a different dynamic. He won just 49 percent of the vote in 2010 and must face an electorate that twice supported Obama.

A South Carolina legislator put it bluntly earlier this year. State Rep. Kris Crawford told a business journal that he supports expansion, but said electoral math is the trump card. "It is good politics to oppose the black guy in the White House right now, especially for the Republican Party," he said.

Whit Ayers, a leading Republican pollster, was more measured, but offered the same bottom line. "This law remains toxic among Republican primary voters," he told The Associated Press.

At the Tennessee Hospital Association, president Craig Becker has spent months trying to break through that barrier as he travels to civic and business groups across Tennessee. "It's really hard for some of them to separate something that has the name 'Obamacare' on it from what's going to be best for the state," he said, explaining that personality driven politics are easier to understand than the complicated way that the U.S. pays for health care.

Medicaid is financed mostly by Congress, though states have to put in their own money to qualify for the cash from Washington. The federal amount is determined by a state's per-capita income, with poorer states getting more help. On average in 2012, the feds paid 57 cents of every Medicaid dollar. It was 74 cents in Mississippi, 71 in Kentucky, 70 in Arkansas and South Carolina, 68 in Alabama. Those numbers would be even higher counting bonuses from Obama's 2009 stimulus bill.

Obama's law mandated that states open Medicaid to everyone with household income up to 138 percent of the federal poverty rate ? $15,420 a year for an individual or $31,812 for a family of four. The federal government would cover all costs of new Medicaid patients from 2014 to 2016 and pick up most of the price tag after that, requiring states to pay up to 10 percent. The existing Medicaid population would continue under the old formula. In its ruling on the law, the Supreme Court left the details alone, but declared that states could choose whether to expand.

Hospital and physician lobbying groups around the country have endorsed a bigger Medicaid program. Becker said he explains on his road show that the Obama law paired Medicaid growth with cuts to payments to hospitals for treating the uninsured. Just as they do with Medicaid insurance, states already must contribute their own money in order to get federal help with those so-called "uncompensated care" payments.

The idea was instead of paying hospitals directly, states and Congress could spend that money on Medicaid and have those new beneficiaries ? who now drive costs with preventable hospital admissions and expensive emergency room visits ? use the primary care system. But the Supreme Court ruling creates a scenario where hospitals can lose existing revenue with getting the replacement cash Congress intended, all while still having to treat the uninsured patients who can't get coverage.

Becker said that explanation has gotten local chambers of commerce across Tennessee to endorse expansion. "These are rock-ribbed Republicans," he said. "But they all scratch their heads and say, 'Well, if that's the case, then of course we do this.'"

In Louisiana, Jindal's health care agency quietly released an analysis saying the changes could actually save money over time. But the Republican Governors Association chairman is steadfast in his opposition. In Georgia, Deal answers pressure from his state's hospital association with skepticism about projected "uncompensated care" savings and Congress' pledge to finance 90 percent of the new Medicaid costs.

Altman, the Kaiser foundation leader, predicted that opposition will wane over time.

Arkansas Republicans, who oppose Democratic Gov. Mike Beebe's call for expansion, have floated the same idea as Haslam: pushing would-be Medicaid recipients into the insurance exchanges. Jindal, using his RGA post, has pushed the Obama administration to give states more "flexibility" in how to run Medicaid.

Deal convinced Georgia lawmakers this year to let an appointed state board set a hospital industry tax to generate some of the state money that supports Medicaid. That fee ? which 49 states use in some way ? is the same tool that Arizona Gov. Jan Brewer is using to cover her state's Medicaid expansion. Georgia Democrats and some hospital executives have quietly mused that Deal is leaving himself an option to widen Medicaid in his expected term.

"These guys are looking for ways to do this while still saying they are against 'Obamacare,'" Altman said. "As time goes by, we'll see this law acquire a more bipartisan complexion."

How to build your own R2D2

R2D2 greets the crowd at this year's Wondercon (Eric Pfeiffer/Yahoo)ANAHEIM, Calif. - The power of the Force may be elusive outside the fictional Star Wars universe but fans of R2D2 can take home their very own astromech droid if they have the time and money to build it.

Inside the halls of Wondercon 2013, hundreds of potential droid crafters waited in line to hear from a panel belonging to the R2D2 Builders Club, a group of hobbyists who have been assembling their own functional Star Wars robots out of aluminum, plastic and even wood since 1999.

But how much time and money does it take to build a bleeping and whirling R2 lookalike?

"That's the magic question," said Victor Franco, who has been building his own droids for over a decade. "It's the one question you don't want your spouse to know the answer to."

And the answer varies, depending on just how detailed and capable you want your droid to be, with the final price ranging from as little as $500 up to $10,000.

"The average cost is a little over $5,000," Franco said. "A single small aluminum part can cost $100. It's not for the faint of heart."

So, if you really want to join the club and build your own remote-controlled R2D2 all you need is some money, a lot of time and some ingenuity. Based on a survey of the panel members, it takes anywhere from 4 to 16 months to build a R2 unit.

Not surprisingly, a large variety of parts and electronics go into replicating one of the droids, with potential parts including plywood, aluminum, resin, styrene, transmitters and receivers speed controller servo motor and circuits.

Some R2D2 replicas have functional parts, like paneling that shoots out from the droid reminiscent of a scene from "The Empire Strikes Back" when the little droid's circuits become overloaded.

"There's no one way to make an R2 unit," said fellow R2 builder William Miyamoto. "The plus side of using plastic is you pretty much can just use an cacti knife and glue."

At the other end of the spectrum, a finished R2 unit made from aluminum can weight more than 200 pounds and forces the creators to decide if they want their droid to be remote controlled or less mobile.

"I did run over a kid once," deadpanned Chris Romines.

But the four R2 builders said it is a project worth both their time and money. And when a droid is complete, it is almost immediately put into service, appearing at conventions and events for children. The droids have even starred in television commercials for companies like Verizon and ESPN and cruised across the red carpet at movie premiers.

They've even been recruited by Lucasfilm to display their creations at official Star Wars events.

When a pair of the hand crafted R2 units took to the stage on Friday at Wondercon, they were greeted with a wave of "oohs and ahhs" normally reserved for cute animal videos, or small children performing adorable tricks.

"I was poor when I was a kid, so I took my toys apart and put them back together," R2 builder Mike Senna said of how he first became inspired to join the R2 club. And like a select few of his contemporaries, Senna has taken his robot building hobby to the next level, having created replicas outside the Star Wars universe, such as Wall-E.

The R2-D2 Builders Club had humble beginnings when creator Dave Everett first launched the club as a Yahoo group, posting the blueprints showing how other aspiring builders could follow his lead.

Today, the club has thousands of members around the world and brought dozens of their robots to the most recent, annual Star Wars Celebration event.

"At the Star Wars Celebration we even have droid races, including a mouse droid race," said Michael McMaster. "But when I started I was electronics illiterate. But that's part of the beauty of our club -- someone will find a part for you, point you in the right direction or even help you build it."

Fighting Breast Cancer Together | San Diego Jewish Journal

The national rate of breast cancer diagnoses is staggering, with the Centers for Disease Control and Prevention reporting more than 211,000 diagnoses in 2009 (the most recent data available), and more than 40,000 deaths from the disease that year. Recently, the National Cancer Institute?s Surveillance Epidemiology and End Results (SEER) studied data from 1975-2009 to determine the breast cancer risk in American women. The report found that women at age 30 have a one in 277 chance of developing breast cancer in the next 10 years, while women age 40 have a one in 68 chance, and women at age 50 have a one in 42 chance.

Sharsheret, a non-profit organization based in Teaneck, N.J., whose name in Hebrew means ?chain,? reports that Ashkenazi Jewish women carry a slightly higher risk than do women in general, with 1 in 40 carrying a gene mutation that is likely to cause breast cancer. While many national groups are working to fund cancer research and providing support for those are genetically predisposed to, currently are diagnosed ?with or are recovering from breast cancer, Sharsheret is the only one with a focus on Jewish women and their families.

The organization believes that talking about the disease and the risk factors can go a long way in early detection and successful recovery.

?We understand that breast cancer is not just a Jewish women?s issue,? explains Elana Silber, director of operations at Sharsheret, ?but rather it is a Jewish community issue.? They work to engage the whole community, including the next generation, by collaborating with on-campus Jewish and philanthropic organizations on more than 100 high schools and colleges to raise awareness and encourage conversations with family members about medical histories.

Jewish Federation of San Diego County?s Young Adult Division brought Sharsheret to the city for the first time in 2011 to host a Pink Shabbat dinner, where young people from around the county gathered to start the breast cancer conversation amongst themselves in a welcoming environment. The program continued in 2012.

Sharsheret is also one of the philanthropies for the national Jewish sorority Alpha Epislon Phi (AEPhi), which has local chapters at San Diego State University and the University of California San Diego.

?We have hosted three Pink Shabbat dinners,? says Katie Borts, current president of AEPhi?s SDSU chapter. ?We ask everyone to wear something pink, and once we made pink challah bread, which was really fun. We also do fundraising events on campus to generate profits for Sharsheret throughout the year.?

Given the known risk of breast cancer in Jewish women, Sharsheret also offers genetic counseling, through which women can speak one-on-one with an experienced geneticist. The ?breast cancer gene,? BRCA, belongs to a class of genes known as tumor suppressors, and genetics researchers at the National Institutes of Health have found more than 1,000 mutations of the gene to be associated with the development of breast cancer. With genetic testing, those concerned with the hereditary risk of breast cancer can choose to find out whether or not they have any of the known cancer-causing mutations. But the results of the test can leave more questions than answers, so the kind of personal support Sharseret offers can go a long way.

That personal connection is what started Sharsheret back in 2001, when a handful of young women sat around founder Rochelle Sortez?s kitchen table talking about recent diagnoses or concerns of being at risk. It has carried through to Sharsheret?s current programming, which works to support women and their families before diagnosis, during treatment and through survivorship.

The organization?s Peer Support program speaks to this whole spectrum by offering one-on-one or group support for women diagnosed with breast cancer. The ?links,? as they are called, are matched from a database of more than 1,800 people ranging from relatives of cancer victims to people currently battling the disease to recent and long-term survivors. San Diego is home to Sharsheret Peer Supporters from La Jolla to Encinitas, San Carlos to Downtown and out to Temecula.

Rabbi Yael Ridberg of Congregation Dor Hadash in San Diego was connected with one of the links in this chain when she was diagnosed with breast cancer in 2003.

?When you yourself are suddenly in the position of dealing with doctor offices and chemotherapy and these things you never imagined you?d have to deal with,? Ridberg shares, ?you really need the friendship and camaraderie that women who have been through it before can offer.?

After a successful recovery and continued involvement with Sharsheret, Rabbi Ridberg is now patiently waiting for her link. ?No one wants to go through this,? she says, ?but if you go through it having learned something, it should be good for something. That is my hope for what I can do now.?

An increased focus on the quality of healthcare in this country has caused survivorship to take on new meaning for federal granting organizations and because of this, Sharsheret recently received a three-year grant from the Centers for Disease Control and Prevention to create and disseminate survivorship resources. As part of this grant, the group has developed a kit available upon request that includes a healthy cookbook, DVD and care plan for working with women who have recently completed treatment.

?The new survivorship program has been generating a lot of energy and excitement, empowering Jewish women as they enter the survivorship phase of their cancer journey,? says Sharsheret?s Silber. ?Healthcare professionals across the country are looking to provide culturally relevant support, and Sharsheret?s resources specifically address the unique needs of Jewish breast cancer survivors.?

By continuing to educate and encourage open dialogue about the risks of breast cancer, Sharsheret is helping people make informed decisions about their health and their future. And though the odds may be seem to be stacked against some people, it?s always nice to know someone who understands is only a phone call away.

Cancer biologists find DNA-damaging toxins in common plant-based foods

Mar. 27, 2013 ? In a laboratory study pairing food chemistry and cancer biology, scientists at the Johns Hopkins Kimmel Cancer Center tested the potentially harmful effect of foods and flavorings on the DNA of cells. They found that liquid smoke flavoring, black and green teas and coffee activated the highest levels of a well-known, cancer-linked gene called p53.

The p53 gene becomes activated when DNA is damaged. Its gene product makes repair proteins that mend DNA. The higher the level of DNA damage, the more p53 becomes activated.

"We don't know much about the foods we eat and how they affect cells in our bodies," says Scott Kern, M.D., the Kovler Professor of Oncology and Pathology at the Johns Hopkins University School of Medicine. "But it's clear that plants contain many compounds that are meant to deter humans and animals from eating them, like cellulose in stems and bitter-tasting tannins in leaves and beans we use to make teas and coffees, and their impact needs to be assessed."

Kern cautioned that his studies do not suggest people should stop using tea, coffee or flavorings, but do suggest the need for further research.

The Johns Hopkins study began a year ago when graduate student Samuel Gilbert, working in Kern's laboratory, noted that a test Kern had developed to detect p53 activity had never been used to identify DNA-damaging substances in food.

For the study, published online February 8 in Food and Chemical Toxicology, Kern and his team sought advice from scientists at the U.S. Department of Agriculture about food products and flavorings. "To do this study well, we had to think like food chemists to extract chemicals from food and dilute food products to levels that occur in a normal diet," he says.

Using Kern's test for p53 activity, which makes a fluorescent compound that "glows" when p53 is activated, the scientists mixed dilutions of the food products and flavorings with human cells and grew them in laboratory dishes for 18 hours.

Measuring and comparing p53 activity with baseline levels, the scientists found that liquid smoke flavoring, black and green teas and coffee showed up to nearly 30-fold increases in p53 activity, which was on par with their tests of p53 activity caused by a chemotherapy drug called etoposide.

Previous studies have shown that liquid smoke flavoring damages DNA in animal models, so Kern's team analyzed p53 activity triggered by the chemicals found in liquid smoke. Postdoctoral fellow Zulfiquer Hossain tracked down the chemicals responsible for the p53 activity. The strongest p53 activity was found in two chemicals: pyrogallol and gallic acid. Pyrogallol, commonly found in smoked foods, is also found in cigarette smoke, hair dye, tea, coffee, bread crust, roasted malt and cocoa powder, according to Kern. Gallic acid, a variant of pyrogallol, is found in teas and coffees.

Kern says that more studies are needed to examine the type of DNA damage caused by pyrogallol and gallic acid, but there could be ways to remove the two chemicals from foods and flavorings.

"We found that Scotch whiskey, which has a smoky flavor and could be a substitute for liquid smoke, had minimal effect on p53 activity in our tests," says Kern.

Liquid smoke, produced from the distilled condensation of natural smoke, is often used to add smoky flavor to sausages, other meats and vegan meat substitutes. It gained popularity when sausage manufacturers switched from natural casings to smoke-blocking artificial casings.

Other flavorings like fish and oyster sauces, tabasco and soy sauces, and black bean sauces showed minimal p53 effects in Kern's tests, as did soybean paste, kim chee, wasabi powder, hickory smoke powders and smoked paprika.

Funding for the study was provided by the National Institutes of Health's National Cancer Institute (CA62924) and the Everett and Marjorie Kovler Professorship in Pancreas Cancer Research.

In addition to Kern, Gilbert and Hossain, other scientists involved in the research include Kalpesh Patel, Soma Ghosh, and Anil Bhunia from Johns Hopkins.

Ashley Judd Won't Run for Senate in Kentucky

After months of flirtation, actress Ashley Judd announced on Wednesday that she will not pursue a Senate bid against Senate Minority Leader Mitch McConnell, R-Ky.

She made the announcement in a series of tweets late Wednesday afternoon:

"After serious and thorough contemplation, I realize that my responsibilities & energy at this time need to be focused on my family. Regretfully, I am currently unable to consider a campaign for the Senate. I have spoken to so many Kentuckians over these last few months who expressed their desire for a fighter for the people & new leader. While that won't be me at this time, I will continue to work as hard as I can to ensure the needs of Kentucky families are met by returning this Senate seat to whom it rightfully belongs: the people & their needs, dreams, and great potential. Thanks for even considering me as that person & know how much I love our Commonwealth. Thank you!"

A source familiar with Judd's decision-making process said the news that Kentucky Secretary of State Allison Lundergan Grimes has also been considering a Senate run "gave her the space to really make a decision and decide what was best for her."

The source said Judd has known she was not running for "the past few days" but only decided to make her decision public on Wednesday.

As late as last Friday, Judd was still hinting at a run, referring to her potential run against McConnell and foreshadowing what she presumed would be a barrage of attack ads from his campaign. She told a conference audience in Cincinnati that she used to be averse to hearing criticism, which she said was ironic because she was "about to get $40 million worth of it."

In the same speech, she also joked that her mother, country star Naomi Judd, couldn't wait to turn her garage into campaign headquarters.

Rep. John Yarmuth, D-Ky., who was one of Judd's most vocal boosters, issued a statement on Wednesday through his spokesman.

"Congressman Yarmuth has said all along he would be surprised if Ashley Judd did not make this race, and he's certainly surprised. While he is disappointed because he believed Judd would be a strong candidate, he's confident that a candidate just as strong will emerge to take on Sen. McConnell, who is the least popular senator in the country," Yarmuth spokesman Stephen George said in a statement to ABC News.

George added that Judd and Yarmuth spoke earlier this week, a conversation in which she did "express some reservations about the race," but he added they had been speaking throughout the process and that was not unusual."

Judd's interest in the race spurred widespread national attention, including from former President Bill Clinton, who spoke to both Judd and Grimes about the seat, encouraging them both to take a hard look at the race.

ABC News reported last week that Clinton encouraged Judd to enter the race and promised he would help her, according to several Kentucky political sources. That conversation happened sometime between the November election and President Barack Obama's second inauguration.

Earlier this month Clinton also met with Grimes after he spoke at an event for former Kentucky Sen. Wendell Ford in Owensboro, Ky., according to multiple political sources in the state. Clinton encouraged Grimes to consider taking on McConnell, adding as he did with Judd that he would support her.

Even with the Hollywood actress's star power, a campaign against McConnell, a political institution in Kentucky, would have been an uphill battle. Shortly after Judd's announcement, the National Republican Senatorial Committee in Washington circulated a list of 10 Kentucky Democrats who have all passed on a chance to take on McConnell, including the state's Democratic governor, Steve Beshear.

"The hollow DSCC spin that Kentucky will be competitive still hasn't made its way to the Bluegrass State," NRSC spokesman Brad Dayspring said in a statement. Citing the list of 10 Democratic names, Dayspring added, "Perhaps number eleven might be a lucky charm?"

Gastellum said in his pre-fight interviews that no one respects his boxing. Uh, they will now. Gastellum struck Hart quickly with a left hook that sent him down to the ground. Hart hit his head on the canvas, rolled over, and took a few more punches before the fight was stopped. It was a vicious, vicious knockout.

Mike Tyson! Oh, hey, no big deal. Mike Tyson showed up at the training center. He stopped in the locker rooms to say hello to the fighters.

A fight for the Queen as Australian Andrews takes on Brit Barnatt. Andrews got the takedown early in the first round, and Barnatt had no answer on the ground for much of the round. Andrews tried for a few chokes, but was unsuccessful.

Barnatt did a much better job in the second, creating offense from the bottom. This led to a third round, where Andrews took over. He knocked a clearly tired Barnatt around until he finally knocked him out in the third round.

Everyone was impressed with how Andrews fought through the third round, including the man signing the checks.

RIM success in 4Q, but too early to declare win

TORONTO (AP) ? Research In Motion Ltd., once written off as dead amid fierce competition from more modern mobile devices such as the iPhone, surprised Wall Street Thursday by returning to profitability and shipping more BlackBerry 10 phones than expected in the most recent quarter.

It will take several quarters, though, to know whether RIM is on a path toward a successful turnaround. RIM just entered the crucial U.S. market with the new phone last week. And despite selling a million BlackBerry 10 phones in other countries, RIM lost subscribers for the second consecutive quarter.

Thursday's earnings report provided a first glimpse of how the BlackBerry 10 system, widely seen as crucial to the company's future, is selling internationally and in Canada since its debut Jan. 31. The 1 million new touch-screen BlackBerry Z10 phones were above the 915,000 that analysts had been expecting for the quarter that ended March 2. Details on U.S. sales are not part of the fiscal fourth quarter's financial results because the Z10 wasn't available there after the quarter ended.

Investors appeared happy with the financial results. RIM's stock rose 34 cents, or 2.4 percent, to $14.91 in afternoon trading Thursday after the release of results. Many analysts had written RIM off last year, but now believe the Canadian company has a future.

"I thought they were dead. This is a huge turnaround," Jefferies analyst Peter Misek said from New York.

Misek said the Canadian company "demolished" the numbers, especially its gross margins. RIM reported gross margins of 40 percent, up from 34 percent a year earlier. The company credited higher average selling prices and higher margins for devices.

"This is a really, really good result," Misek said. "It's off to a good start."

The new BlackBerry 10 phones are redesigned for the new multimedia, Internet browsing and apps experience that customers are now demanding.

The BlackBerry, pioneered in 1999, had been the dominant smartphone for on-the-go business people and other consumers before the iPhone debuted in 2007 and showed that phones can handle much more than email and phone calls. RIM faced numerous delays modernizing its operating system with the BlackBerry 10. During that time, it had to cut more than 5,000 jobs and saw shareholder wealth decline by more than $70 billion.

In the most recent quarter, RIM earned $98 million, or 19 cents a share, compared with a loss of $125 million, or 24 cents a share, a year earlier. After adjusting for restructuring and other one-time items, RIM earned 22 cents a share. Analysts surveyed by FactSet had been expecting a loss of 31 cents.

Revenue fell 36 percent to $2.7 billion, from $4.2 billion. Analysts had expected $2.82 billion.

RIM shipped 6 million BlackBerry devices, including 1 million on the new system. But RIM lost about 3 million subscribers to end the quarter with 76 million. It's the second consecutive quarterly decline for RIM, whose subscriber based peaked at 80 million last summer.

Bill Kreyer, a tech analyst for Edward Jones, called the decline "pretty alarming."

"This is going to take a couple of quarters to really see how they are doing," Kreyer said.

The company also announced that co-founder Mike Lazaridis will leave the company. He and Jim Balsillie had stepped down as co-CEOs in January 2012 after several quarters of disappointing results, but Lazaridis said he stayed on as vice chairman and a board director to help new CEO Thorsten Heins and his team with the launch of the BlackBerry 10. With that underway, Lazaridis plans to retire May 1. He said he has no plans to sell his 5.7 percent stake in the company.

In an interview with The Associated Press, Lazaridis said the board wanted both him and Jim to stay, but Lazaridis decided "it was the right time" to leave.

Heins, formerly RIM's chief operating officer, has spent the past year cutting costs and steering the company toward the launch of new BlackBerry 10 phones. Lazaridis said Heins has done an excellent job completing the BlackBerry 10 system and launching it around the world.

"The results speak for themselves," Lazaridis said.

Sterne Agee analyst Shaw Wu said RIM returned to profitability much sooner than expected. He said it was driven by higher gross margins, cost reductions and the sale of the new BlackBerry.

In a research note, Wu wrote that RIM "is here to stay with stabilization in its business and balance sheet" but said the key question remains whether the company can maintain momentum in an industry dominated by Apple and Google's Android software.

The Z10 has received favorable reviews since its release, but the launch in the critical U.S. market was delayed until late this month as wireless carriers completed their testing.

A version with a physical keyboard, called the Q10, won't be released in the U.S. for two or three more months. The delay in selling the Q10 complicates RIM's efforts to hang on to customers tempted by the iPhone and a range of devices running Android. Even as the BlackBerry has fallen behind rivals in recent years, many users have stayed loyal because they prefer a physical keyboard over the touch screen on the iPhone and most Android devices.

RIM, which is changing is formal name to BlackBerry, said it expects to break even in the current quarter despite increasing spending on marketing by 50 percent compared with the previous quarter.

"To say it was a very challenging environment to deliver improved financial results could well be the understatement of the year," Heins said during a conference call with analysts.

Heins said more than half of the people buying the touch-screen Z10 were switching from rival systems. The company didn't provide details or specify whether those other systems were all smartphones. He said the Q10 will sell well among the existing BlackBerry user base. It's expected in some markets in April, but not in the U.S. until May or June.

Amazon just announced that it is adding its X-Ray feature to TV shows. The feature already worked with movies thanks to data from IMDb, but the company will now use this very same data for other video content. All the Kindle Fire family will receive the feature. The Amazon Instant Video app on Wii U will get is as well. As a reminder, X-Ray allows you to discover more about the content you are reading or watching. It first appeared with books, it shows you the different characters, where they appear in the book and how they are related to the story. Then Amazon added X-Ray to movies back in September 2012. In that case, watchers can instantly know the name of an actor in a scene. IMDb is an Amazon company, allowing the Kindle team to tap into a very comprehensive movie database. As IMDb provides data for TV shows as well, adding TV shows to X-Ray was just a matter of time. The idea is to make the video experience unique on Amazon’s devices, making people want to buy those tablets and stay in the Amazon ecosystem. It’s been known that Amazon doesn’t make much profit from selling hardware. Instead, it wants people to use the Kindle Fire tablets to buy content. Of course, the X-Ray feature only works with videos you buy or rent from Amazon Instant Video or videos from the Amazon Prime collection. X-Ray could be one of those little features that make you choose Amazon over Netflix or iTunes. In addition to providing the X-Ray feature to Kindle Fire users, the feature will make its way to Amazon Instant Video’s Wii U app. This little fact shows that what matters for Amazon is that people consume content from Amazon, no matter the platform. X-Ray for movies and TV shows may eventually come to Android and iOS. 5 tech policies law firms should consider to prep for job departures ...

A St. Louis managing partner recently found a note on his desk when he returned from lunch, informing him that five lawyers had left his firm. Not all departures are that dramatic, but unless a firm expects and has experience with lawyer transitioning, the process is not likely to be a smooth one, especially where technology is involved.

Lawyers routinely advise clients to create employee manuals, have technology policies, and put in place checklists and procedures to cover these kinds of occurrences. But many firms do a poor job of following their own advice. Common responses to the technology issues raised by a departing lawyer or employee can be ad hoc, chaotic and woefully incomplete, raising more problems than the firm solves. It obviously makes great sense to have technology transition policies and procedures in place, given the proliferation of portable devices. Let?s look at some of the key concerns you?ll want to address:

? You will want to act quickly on restricting or limiting Internet access. A good first step would be to eliminate the existing user account and create a temporary account with limited rights and access to only necessary resources and actions. Even if you trust the departee, lax security practices by one person can expose your whole network. Consider whether other users should change their passwords. Will you require smartphones and other devices to be turned in immediately?

? Make a determination about whether an email account can be retained, perhaps with supervision, or whether email should be redirected to an account where it can be held and screened. What documents can be copied or downloaded? If you use cloud-based services for case management or other purposes, should access be taken away or restricted?

? Get a list of all hardware, software and services the departing person uses, as well as a list of documents, directories and other data the person has stored or used. It?s especially important to find out what templates, documents and the like have been copied, forwarded or downloaded, especially if a lawyer leaves to go to a competitor.

? In some cases, you might want to hire a computer forensics consultant or an IT consultant to determine what the departing person has done before leaving, especially if sensitive client data is involved or you have concerns about what the person might have taken.

? And are there unique technology concerns you must address? One example is disclosure of passwords for services or documents. Many people keep copies of personal documents and photos on their work computers. How will you deal with that? What happens if the departing person wants to keep or won?t return a laptop computer? Is information subject to a litigation hold involved?

I spoke with a savvy small-firm lawyer who handles the technology issues immediately after a departure. He gets the issues resolved, documents them, and gets appropriate releases and agreements. If necessary, he updates the firm?s policies and procedures.

Compare these procedures to the ones you have now or you might wish you had when the time comes.

Powerball winner's outstanding debt: child support

(Reuters) - The winner of one of the biggest Powerball jackpots of all time owes $29,000 in overdue child support payments, the Passaic County, New Jersey, sheriff's office said on Thursday.

Pedro Quezada, 44, a county resident who is married and the father of five children ages 5 to 23, was the sole winner of a $338 million jackpot on Saturday.

Because he chose the lump sum option, instead of annual payments over 30 years, he will actually receive $211 million, lottery officials said on Thursday. Officials said that is the third-largest lump sum payment in Powerball history.

The lottery will take out a total of 28 percent in federal and state taxes, which would leave Quezada, who until this week was the owner of a bodega in Passaic, New Jersey, with about $152 million.

His Apple Deli & Grocery now has a "for sale" sign on the door. Quezada told reporters on Tuesday that the business is now closed.

Passaic County Sheriff Richard Berdnik said in a statement that his office is attempting to notify Quezada about the support payment. He said that generally the state's lottery division would pay the judgment out of the winnings.

"Like everyone else, until this warrant is satisfied, Mr. Quezada is subject to potential arrest," the statement said.

The child support issue dates back to 2009, according to local media reports.

Quezada could not be reached for comment.
